any future lawyers in the house? need some law savvy people for advice.
in a return email to me, her bf states that he spoke to his lawyer and found that the thread is in violation of a few laws including:

if this is so, why aren't celebrities everywhere suing the paparazzi? i think that the offensiveness of the thread content is relative to the person it's about. i don't mean to sound insensitive but she is a porn star, and with that comes a certain amount of liability.
he also cites copyright law concerning posts containing links to "copyrighted materials of videos from more than one company". i would suggest that "akamikedavid" take those down for the meantime for his own sake.
please do not post *NWS* links or material in this thread. |

I feel sorry for her, but SHE IS A PORN STAR.
Does her boyfriend want us pay per thread response? Besides, the damage is done. Whatever happens now will only negatively impact her and her boyfriend a 1000x more in the coming weeks.
These threads usually just come and go, (not to threadjack again) but look at the Alicia Coates fiasco, the Tritons Moronic kept reposting on the board constantly accusing me of being a sexist and defending coates. For all the regulars, that thread was long dead . As in, a few months long dead.
If boyfriend #301 continues to legally barrage sduncensored, then this will only rise in news and publication. I smell the Koala around, as well as a possible Digg/social etc. in the making.
I reiterate; Evelyn Lin and Matt Joen and others, do not continue to legally assault SDUNcensored. The only thing that will come out of this is more negative publicity for you, your friends and associates. This is not a threat, and does not constitute either the basis for one, or possible implication of one, it is simply bare fact for you to decide whether or not a protracted legal battle against SDUncensored (Which will most likely continue into the school year, and distribute a story, which, speaking personally, has spread already around my group of associates), is worth your while.

Hey Joe you locked the other thread, how could mikedavd or myself remove the links. Ok I would have to agree though that the link to the copyright works is valid, but then again is the studio suing you? Still, I would remove those links then.
However even in that law - it says "private affairs"
We have never posted anything private such as address, social security number, private pictures, etc. Every bit of information was found on the Internet. Her photos are public on the Internet. She posted her information about her herself. So did he. This guy has no case against you or me or anybody on this site.
No worries though, if he wants to make it worse and if he does sue me, I have legal insurance, so I'm covered. And the lawsuit would be so absurd that I will tell all my blog friends about this lawsuit on my FREEDOM OF SPEECH right and it will be all over the Internet, and she will be famous even more. This guy is suing the wrong people. Sue the guys at the studio, sue that one myspace guy who called him a prick and gave her real name. We have not threaten this guy or her, nor have we said anything false.
I am not sorry about all this now, since eventually somebody would find out and tell someone else etc.
Why don't you log on and explain to us why we are in violation of your rights, Matt?

Go back, and look at your posts, you still have the 'edit' button available to you. Just go and 'edit-delete' everything you want gone.

Dude, you caved in harder than Evelyn's double-penetrated ass. All ya had to do is have mikedavid and the initial remove the links. There is no way you could get sued for something which is out there for everyone to see, though.
Btw, mikedavid, please pm the links 'cause joe is too much of a loose cooter to keep them up

No you can't edit it will say it is locked. I would edit out any links to videos that mikedavid and i uploaded.
However, the links to the other websites are valid & legal.
Exactly Nox, if she kept her private/school life separate she shouldn't have told them she even go to school!!
Her bf's myspace is now private (but still cached on google, why not sue Google?). and so is his facebook.

I hate to break it to the boyfriend, but his lawyer is very mistaken. I would strongly suggest if he's serious about pursuing legal action to contact a lawyer well versed in adult entertainment and privacy law (there are a few in San Diego and Los Angeles who are very well versed that aren't too tough to get a hole of). There are absolutely no privacy protections for an actor or actress who does an adult video because of the many requirements on the producers side, in particular record maintaining persuant to Federal Law USC 2257. If her Myspace page, links to discussion forums where she's commented, and other pages normally available to the public are brought up there's really no pertinent legal issue of privacy. Now if she has her personal phone number or other private info distributed, or she received unsolicited private e-mails, then there could be a privacy issue, but at this point looking at the other thread there's really not much here that could possibly lead to civil litigation.
Basically any filmed participant who engages in sex on camera needs to file two forms of ID with the producer of any adult movie to document the person being filmed is at least 18. Anyone who stars in an adult video really gives up their right to privacy at this point because their real name, address (and likely social security number) is on file for the federal government to see, not to mention the contact and model release they've likely signed with the production company. Given that Red Light District just had a visit from the FBI a few weeks ago to check these records (and in particular it was for their titles with younger actresses which would match Evelyn's movies) its more of an issue in my opinion as FBI agents have digitial copies of her Driver's license, SSN and other IDs she provided to RLD. Now thats freaky.
While Evelyn may not have protection from having her real name linked on a discussion board by members of the public, she does have very strong legal protections as a UCSD student from any UCSD administrator, official or employee from contacting her about this. Its very likely her dean or other officials will contact her; under a California state law her actions here are protected under the first Amendment and cannot subject her to any sort of disciplinary action from the school or any encroachment on her privacy rights because of what she does in her spare time.
Now the issue of entire scenes from her movies being posted is a serious one; but these would be for the production company's lawyers who produced these films to deal with the person(s) who posted said copyrighted material and the sites they're hosted on. It really isn't in the legal jurisdiction of Evelyn, her boyfriend, or their lawyers unless she has produced one of the movies herself. It would likely be in your best interest, Joe, to remove the links to the entire scenes. You'd be fine keeping up the posts of gallery previews and preview pics (including her model listing) as those are intended for public consumption (for free) and for viewing...the scenes ripped from the DVD are NOT. Remove those links immediately to save yourself some possible hassles.
Now, it is very tough being an adult actor or actress and having your entire private life exposed, but thats just how it is in this business. The private details of many of the aspects of your private life can be dredged up at any time; not only your personal details but even your monthly STD testing can be legally obtained....it is very freaky and in my view there are not enough protections for people's privacy in this business. But that's the law.
Rather than running from it, I'd suggest embracing it. UCSD has its own share of adult film stars; Aria Giovanni went here, as have a number of other amateur female stars (some with their lives very public, and others who keep their secret at UCSD) and even some pretty prominent members of the adult industry. Evelyn is protected under state law to do this in her private life and remain a student; this is a legal protection ONLY available in California and at public colleges, and no where else in any other state.
I realize for Evelyn this is certainly a tough time, but there's no reason to drop out of school or take drastic actions. Certianly a career (even as brief as a single scene) in Adult can be tough and open you up to unwanted attention and invasions or privacy and thats unfortunate. But really this industry could use cool, well-educated people (she does go to UCSD after all) to change people's minds about it and aren't afraid to proclaim what they do for a living. So many other models would fucking DIE for a chance to go to college, especially a school like UCSD; don't let your career and personal choices affect your education.
